1. Introduction & Acceptance
Welcome to BUMA ("BUMA," "the Platform," "we," "us," "our"), a product of شركة أهداف مرنة للاستشارات والتدريب (Ahdaf Consulting and Training) ("Ahdaf"). These Terms & Conditions ("Terms") govern access to and use of the BUMA platform, including our website, learning tools, and related services (the "Service").
By creating an account, enrolling a child, or otherwise using the Service, you agree to these Terms. If you are a parent or guardian, you are agreeing on behalf of yourself and your child. If you represent a school, teaching center, or nonprofit organization, you confirm you have the authority to accept these Terms on that organization's behalf.
If you do not agree to these Terms, please do not use the Service.
2. Who Can Use BUMA
- Parents/Guardians may create an account on behalf of their child to access BUMA's learning tools.
- Schools, Teaching Centers, and Nonprofit Organizations may enroll under an organizational account, with designated trainers and administrators managing classes and students.
- Children use BUMA under the account and supervision of a parent, guardian, or enrolling organization. Children do not independently accept these Terms.
- BUMA is intended for use by children primarily on desktop/laptop computers; the Buma Adventures module also supports tablets. BUMA is not designed or supported for use on mobile phones.
3. Children's Privacy & Data
We take the protection of children's information seriously.
- What we collect for students: first name or a display name, an avatar selection, learning progress, and projects created on the platform. We do not require an email address from students, and young students log in using a class code and picture-based or PIN-based login rather than email/password credentials.
- How we use it: solely to provide and improve the Service — tracking progress, enabling trainers and parents to view relevant learning activity, and generating reports.
- Consent:
- Where a parent creates an account directly for their child, the parent's acceptance of these Terms serves as their consent.
- Where a child is enrolled through a school, teaching center, or nonprofit organization, that organization is responsible for obtaining appropriate parental/guardian consent in accordance with applicable local laws before enrolling any child on the Platform.
- No advertising to children: we do not use children's data for advertising, marketing, or any purpose beyond providing the Service, and we do not sell children's personal information.
- Data retention & deletion: we retain student data only as long as necessary to provide the Service. A parent, trainer, or organization administrator may request deletion of a child's account and associated data by contacting info@ahdaf.me.
- Data isolation: data belonging to one organization (school/center) is never accessible to another organization using the Platform.
4. Accounts & Roles
BUMA supports multiple account roles: parent, student, trainer, center/enterprise administrator, and BUMA staff roles (role manager, super admin). Each account holder is responsible for keeping their login credentials (or, for students, their class code and PIN/picture-password) confidential and secure. Organizations are responsible for the accounts of trainers and students they create or manage.
5. Free Access for Nonprofits
BUMA offers free access to qualifying nonprofit organizations, community centers, and charities working with children from underserved backgrounds, subject to application and review. Free access is granted at BUMA's discretion, is not guaranteed to any applicant, and may be modified, limited, or revoked in cases of misuse or if an organization no longer meets the qualifying criteria.
6. Payment Terms (Schools & Teaching Centers)
Pricing for schools and teaching centers is quote-based and structured per class/group rather than strictly per student, as agreed individually with each organization. Payment terms, invoicing schedule, and currency will be confirmed in each organization's individual agreement or quote. BUMA reserves the right to suspend access to an organization's account in the event of non-payment, following reasonable notice. Refund terms, if applicable, will be specified in the individual agreement.
7. Intellectual Property Rights
7.1 BUMA's Intellectual Property. The BUMA platform, including its name, logo, mascot design, curriculum content, lesson plans, presentations, software, and underlying code, is the intellectual property of Ahdaf and is protected by applicable copyright, trademark, and intellectual property laws. These Terms do not grant any license to copy, reproduce, distribute, sell, or create derivative works from BUMA's platform, branding, or curriculum content for commercial purposes without our prior written consent.
7.2 User-Generated Content. When a child creates content on BUMA — including drawings, stories, animations, code projects, or pixel art — ownership of that content remains with the user (or their parent/guardian, on their behalf). By creating and saving content on the Platform, the user grants Ahdaf a limited, non-exclusive license to store, display, and process that content solely to provide and improve the Service. We do not sell, license, or use children's created content for advertising or any purpose beyond providing the Service.
7.3 Feedback. If a user, trainer, school, or center provides suggestions or feedback, we may use it to improve BUMA without obligation or compensation to the person who provided it.
7.4 Third-Party Content. Where BUMA links to or embeds third-party tools (such as Google Workspace applications, Piskel, or Canva), those tools remain the property of their respective owners and are governed by their own terms of use.
8. Protection of Personal Information
8.1 Our Commitment. We collect and process personal data only as necessary to provide the Service, in accordance with this section and our separate Privacy Policy (where published).
8.2 What We Collect.
- For children/students: first name or display name, avatar, learning progress, and platform-created projects.
- For parents, trainers, and administrators: name, email address, phone number, and organization details necessary to manage accounts and communications.
- For organizations: organization name, contact details, and enrollment/billing information as applicable.
8.3 How We Use Personal Information. Solely to operate the Service, enable progress tracking and reporting, communicate necessary account/service information, and process payments where applicable. We do not sell personal information, and we do not use children's data for advertising.
8.4 Data Security. We implement reasonable technical and organizational measures to protect personal information from unauthorized access, alteration, disclosure, or destruction, including role-based access controls ensuring data isolation between organizations.
8.5 Your Rights. Depending on your jurisdiction, you may have rights to access, correct, or request deletion of personal information we hold about you or your child. To exercise these rights, contact info@ahdaf.me.
9. Acceptable Use
Users may not: attempt to access another organization's data or accounts without authorization; misuse or attempt to circumvent the Platform's safety features (including those protecting children); use the Service for any unlawful purpose; or copy, resell, or redistribute BUMA's curriculum or platform content commercially without authorization.
10. Platform Availability & Changes
BUMA may update, modify, or discontinue features of the Service from time to time. We will provide reasonable notice of material changes affecting schools and teaching centers where practicable. We do not guarantee uninterrupted availability of the Service.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Ahdaf and BUMA shall not be liable for indirect, incidental, or consequential damages arising from use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Governing Law
These Terms are governed by the laws applicable in Palestine, without prejudice to any mandatory local consumer or data protection laws applicable to schools, centers, or families located in other jurisdictions.
